In Texas, the difference between community property and separate property could significantly impact the division of property. Separate property is anything owned or claimed by a spouse prior to marriage, property acquired by a spouse during the marriage by gift, devise, or descent, or the recovery for personal injuries sustained by a spouse during a marriage, except for recovery for loss of earning capacity during a marriage. This definition comes directly from Texas Family Code section 3.001.
